社会组织论文：论社会组织在我国社区矫正制度构建中的定位与作用

【中文摘要】19世纪产生的实证犯罪学派认为犯罪原因存在复杂性和多重性,他们主张进行刑罚改革,实现行刑方式的现代化,这一学派的理念对近现代国家的刑法和刑罚制度产生了重要的影响,在他们的倡导下,刑罚文明已经成为整个社会文明的一个重要组成部分和表现形式,以社区矫正为主要方式的社会化刑罚执行形态已经成为一种不可逆转的世界行刑发展趋势,包括中国在内的一些发展中国家也开始尝试进行刑罚改革,探索适合自己国家的非监禁刑行刑模式。2002年8月,上海在全国率先开展了社区矫正的试点工作,在试点过程中,上海社区矫正工作的组织部门引入社会治理的理念指导社区矫正试点工作、重视社会组织和专业社会工作者在社区矫正试点工作中的作用、并在全市范围内培育成立了上海市新航社区服务总站、以政府购买服务的形式来推动社区矫正工作的做法,被称为“上海模式”,受到我国社区矫正研究理论界和实务部门的广泛关注。笔者作为一名社区矫正实务部门的工作者,以上海市新航社区服务总站为切入口,全面分析了社会组织在我国社区矫正制度构建中的定位和作用,为我国社区矫正制度的进一步发展提供了一些建议和对策。本文除引言外,共分为四章。引言部分主要阐述了问题的由来、相关研究的情况和本文的理论基点和主要论点。第一章主要概述了我国社区矫正产生和发展现状,着重论述了社区矫正、社会组织的基本含义、社区矫正制度

生成中的组织介入和我国社区矫正制度的主要探索样式。第二章以上海市新航社区服务总站为例,详细分析了新航社区服务总站的体制、运作状况、面临问题,探讨了新航社区服务总站参与社区矫正制度构建的意义。第三章在前文分析的基础上,对现阶段社会组织参与我国社区矫正存在的主要问题和限制性因素进行了总结归纳,并对国外及我国香港地区社区矫正制度的发展现状予以了介绍。第四章笔者从明确法律地位、探索运作模式、发挥积极作用等多个方面,提出了进一步推进和完善我国社会组织参与社区矫正制度构建的相关建议。

【英文摘要】The empirical crime school in the 19th century presumed the existence of causes of crimes in complexity and multiplicity. They advocated penalty reform and modernization in the mode of execution, and the theory of the school then had a major impact on modern country’s criminal law and penalty system. Under their advocacy, penalty civilization has been an important part of the overall social civilization and presentation. Therefore, community correction as the main pattern of socialized penalty execution now is an irreversible trend in world execution development. Some developing countries including China try to reform penalty, and to explore a non-custodial penalty execution mode which should suit their own countries.In august,2002, China’s first pilot work of community correction was carried out in Shanghai. During the

course of work, the organization departments of Shanghai community correction introduced the concept of social control to guide the community correction trial, and emphasized the function of social organizations and professional social workers. Moreover, they have cultivated and set up Shanghai Xinhang Community Service Center all around city. The mode in which the government procures services to promote the practice of community corrections is called “Shanghai Mode”. It has gained wide attention in China’s theoretical circle of community correction study and practice departments. As a community correction worker of practice department, the writer started from Shanghai Xinhang Community Service Center, Comprehensively analyzed position and role of social organizations in china’s construction of community correction system. With a view to provide the necessary basis for further promoting and perfection of community correction.The paper was divided into four chapters except the introduction. Firstly, the introduction expounded the origin of the problem, related studies, and theoretical basis and main points associated with this paper. The first chapter was summarized emergence and development of community corrections of the country. It also discussed mainly on basic meanings of community corrections and

community organizations, organization intervention of community correction system and the major exploration mode of our community correction system. In the case of Shanghai Xinhang Community Service Center in Chapter 2, system, operation status and problems facing the center were analyzed in detail, and the significance of the center participation in community correction system construction was investigated. Based on previous analysis, there were summary and induction on main problems of social organizations’ participation in community corrections at the stage in Chapter 3, and the introduction of social organization’s present development in foreign community correction. By clearing legal status, exploring the mode of operation and playing a positive role in many aspects, the fourth chapter was to propose further promoting and improving china’s social participation of community correction system construction.
